Purpose
- These Terms of Service (hereinafter "these Terms") set forth the conditions of use for the various services (hereinafter "the Services") provided by Saigen Inc. (hereinafter "the Company"). Users of the Services (hereinafter "Users") may use the Services by agreeing to these Terms.
Changes to the Terms of Service
- The Company may revise these Terms without prior approval from Users, and Users shall accept such revisions. The revised Terms of Service shall take effect from the time they are posted on the Services.
Use of Personal Information
- In providing the Services, the Company shall use Users' personal information in accordance with a separately established Privacy Policy.
Usage Environment
- To use the Services, an iOS device, Android device, or personal computer is required. However, depending on the User's environment, normal operation may not always be guaranteed.
Copyright
- Copyrights and intellectual property rights related to the Services belong to the Company.
- Copyrights and intellectual property rights related to information provided by the Company through the Services belong to third parties who hold legitimate rights to such information.
Prohibited Activities
Users shall not engage in the following activities when using the Services:
- Acts that infringe or may infringe upon the copyrights, other intellectual property rights, or financial interests of the Company or third parties
- Acts that violate or may violate laws, regulations, or public order and morals
- Acts that cause or may cause disadvantage to other Users or third parties
- Acts that interfere or may interfere with the operation of the Services
- Acts that damage or may damage the reputation of the Company or the Services
- Reverse engineering, decompiling, or disassembling software information and copyrighted works contained in the Services
- Unauthorized access to the Company's network and internet servers used to provide the Services (hereinafter "Target Equipment"), or unauthorized modification or deletion of stored information
- Sending viruses or other harmful computer programs to the Target Equipment
- Placing excessive load on the Target Equipment
- Any other acts deemed inappropriate by the Company
Suspension of Service Use
The Company may immediately suspend the use of the Services and revoke the usage rights of any User who falls under any of the following categories, without prior notice. If usage rights are revoked, the User shall promptly destroy all programs and data related to the Services.
- When the User has violated or is likely to violate any provision of these Terms
- When the User has violated any law or ordinance, including copyright law and patent law, in connection with the Services or other dealings
Temporary Interruption and Suspension of Services
The Company may interrupt the provision of the Services without prior notice to or approval from Users in any of the following cases:
- When emergency maintenance of Service equipment is required
- When internet use is unavailable due to problems occurring on the internet
- When internet use is unavailable due to problems with communication equipment owned by the internet connection service provider to which the Company outsources internet connectivity for the Services
- When it becomes difficult to provide the Services due to actions of third parties other than the Company, such as a telecommunications carrier ceasing to provide telecommunications services
- When unavoidable for operational or technical reasons
- When the Services cannot be provided due to fire, power outage, or similar events
- When the Services cannot be provided due to natural disasters, war, riots, civil unrest, enactment or revision of laws and regulations, orders or dispositions by public authorities, labor disputes, accidents involving transportation or communication lines, non-performance by third parties, or other force majeure events beyond the Company's control
- The Company shall not be liable for any damages suffered by Users or any third parties resulting from the inability to provide the Services due to any of the events described in the preceding items.
Changes to Services
- The Company may change, interrupt, suspend, or terminate all or part of the Services at any time and for any reason without prior notice to Users.
Disclaimer
The Services are used at the User's own judgment and responsibility, subject to the User's acceptance of the following, and the Company shall not be liable for any loss or damage incurred by the User:
- The Company shall not be liable for any damages incurred by Users in connection with the use or inability to use the Services, regardless of the reason.
- The Company makes no warranty regarding the operation of the Services or their compatibility with any equipment.
- The Company makes no warranty regarding the completeness, accuracy, legality, usefulness of the Services, or the accuracy, validity, legality, usefulness of information obtained through the use of the Services, or any other matters.
- The Company shall not be liable for any damages caused by reduced display speed or failures of the Services due to excessive access or other unforeseen causes.
- The Company shall not be liable for any damages caused by changes, interruptions, suspensions, or termination of the Services.
Liability for Damages
- If the Company suffers damages due to a User's actions, or if the Company suffers damages as a result of claims from other Users or third parties due to a User's actions, the Company may claim damages from said User, and the User shall immediately pay the claimed amount to the Company.
- If the Company suffers damages due to disputes between a User and other Users or third parties, the User shall compensate the Company for such damages.
- If a User infringes upon the rights or interests of the Company in connection with the use of the Services, the Company may claim damages from said User.
Governing Law
- The formation, validity, performance, and resolution of these Terms shall be governed by the laws of Japan.
Jurisdiction
- In the event of any dispute arising in connection with these Terms, the Tokyo District Court shall have exclusive jurisdiction as the court of first instance.
